Buyer Terms of Sale

1. Who You Are Buying From

Streamster is a technology platform that enables independent sellers to sell directly to buyers during live video streams. When you purchase a product, you are entering into a sale contract with the seller, not with Streamster. The seller is the merchant of record for your purchase. Streamster is not the seller, is not a party to the sale, and does not take title to any product.

2. What Streamster Is Responsible For

Streamster provides the technology (the streaming platform, the checkout interface, and payment facilitation via Stripe). Streamster is responsible only for the availability and operation of that technology.

3. What the Seller Is Responsible For

The seller is solely responsible for: the product and its description, quality, and authenticity; pricing; packaging, shipping, delivery, and fulfillment; returns, refunds, cancellations, and their own refund policy; product warranties; and compliance with all laws applicable to the sale of their products. Any question, complaint, or claim about your product, your shipment, delivery, or a refund must be directed to the seller.

4. Shipping and Delivery

Shipping is arranged and fulfilled by the seller. Delivery timeframes, carrier selection, shipping damage, loss, and delays are the responsibility of the seller and their chosen carrier. Streamster does not ship products and is not responsible for shipping outcomes.

5. Returns, Refunds, and Cancellations

Each seller sets and honors their own return, refund, and cancellation policy. Refunds are issued by the seller. Streamster does not set, control, or guarantee any seller's refund policy and does not issue refunds on the seller's behalf.

6. Payment

Payments are processed by Stripe on the seller's connected account. Your card statement reflects a charge associated with the seller's sale. Streamster receives a platform fee but is not the recipient of the purchase price.

7. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Streamster provides the platform “as is” and “as available” and disclaims all warranties regarding products sold through it, including merchantability, fitness for a particular purpose, authenticity, and non-infringement. Streamster makes no warranty about any product, seller, or the outcome of any transaction.

8. Limitation of Liability & International Consumers

To the maximum extent permitted by applicable law, Streamster is not liable for any loss, damage, or claim arising from a product, its sale, shipment, delivery, or a seller's acts or omissions; and Streamster's aggregate liability relating to the platform is limited to the platform fees Streamster received on the relevant transaction.

Nothing in these terms limits or excludes any right you have under mandatory consumer protection law that cannot be waived, including rights buyers may have in the United Kingdom, European Union / Ireland, Australia, and New Zealand. Where such law grants you rights against a platform or seller that these terms cannot exclude, those rights prevail.

⚖️ For legal review — This section is the core liability shield AND the international carve-out. Buyers ship to US/CA/GB/AU/IE/NZ. UK CRA 2015, EU consumer directives, Australian Consumer Law, and NZ CGA impose non-excludable rights and may treat an online marketplace as bearing certain obligations regardless of disclaimers. Please confirm the shield is enforceable where allowed and the carve-out is adequate where not.
