Terms of Service

Last Updated: April 21, 2026 | Effective Date: April 21, 2026

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Streamster, operated by Matthew Rosan ("Streamster," "we," "us," or "our"), a sole proprietorship organized under the laws of the Commonwealth of Virginia. By accessing or using the Streamster platform at streamster.shop (the "Platform" or "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease all use of the Service.

2. Description of Service

Streamster is a live-stream commerce marketplace that enables sellers to broadcast live video content, display and sell products in real time, and engage with audiences, and enables buyers to discover, watch, and purchase products through live streams. The Service includes web-based tools, application programming interfaces (APIs), streaming infrastructure, payment processing integration, and related features. Streamster acts solely as an intermediary platform facilitating transactions between buyers and sellers and is not a party to any transaction between users.

3. Eligibility

You must be at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract under applicable law to use the Service. By creating an account or using the Platform, you represent and warrant that you meet these requirements. If you are accessing or using the Service on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms. We reserve the right to request proof of age or legal capacity at any time and to suspend or terminate accounts that do not meet these eligibility requirements.

4. Seller Accounts and Registration

The Platform provides accounts for sellers only:

  • Seller Accounts: Users who broadcast live streams, list products for sale, and conduct transactions through the Platform. Sellers are subject to additional obligations including compliance with all applicable consumer protection, tax, and commerce laws.

Buyers do not create accounts. Buyers purchase as guests and provide only the contact and shipping information necessary to complete an order at checkout.

As a seller, you agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately at support@streamster.shop of any unauthorized use of your account or any other breach of security.

5. Fees, Commissions, and Payment Terms

By using the Service, you agree to the following fee schedule. All fees are in United States Dollars (USD) unless otherwise stated.

5.1 Seller Subscription Plans

Streamster offers two subscription plans. Each plan includes a monthly allotment of live streaming hours; additional live hours are billed as metered overage at $5 per additional live hour on both plans.

PlanMonthly FeeWhat's Included
Starter$79/month10 live streaming hours/month, Facebook & Instagram live streams, Streamster overlays & countdown timers, real-time sales analytics, CSV product import, OBS/RTMP setup, 4% platform commission. Additional live hours billed at $5/hour.
Creator+$199/month40 live streaming hours/month, Facebook & Instagram live streams, Streamster overlays & countdown timers, real-time sales analytics, CSV product import, OBS/RTMP setup, 1-click shipping label printing, 2% platform commission. Additional live hours billed at $5/hour.
Pro$499/month150 live streaming hours/month, all platforms (FB, IG, TikTok, YouTube), Streamster overlays & countdown timers, real-time sales analytics, CSV product import, OBS/RTMP setup, 1-click shipping label printing, priority chat support, 1% platform commission. Additional live hours billed at $5/hour.

Platform focus: Streamster is built for sellers who go live on Facebook and Instagram. YouTube and TikTok integrations are currently paused while we focus on delivering the best possible live selling experience on Meta's platforms. Existing connections have been preserved; new connections are temporarily unavailable.

5.2 No Buyer Fee

Buyers pay no Streamster fee. Buyers pay only the product price plus any applicable sales tax, which is calculated and collected at checkout. The seller is the merchant of record for each sale.

5.3 Platform Commission

In addition to your monthly subscription, Streamster charges a platform commission based on your subscription tier — Starter 4%, Creator+ 2%, or Pro 1% — on the gross merchandise value (GMV) of each transaction processed through Streamster checkout. The original founding sellers retain a grandfathered 1% commission, which supersedes the tier rate. This commission is deducted from your seller payout at the time of settlement.

5.4 Payment Processing Fees

All payments are processed through Stripe, Inc. ("Stripe"). Stripe's standard payment processing fees are passed through to the seller and deducted from the seller's payout. Streamster does not mark up or add surcharges to Stripe's processing fees. Current Stripe fee schedules are available at stripe.com/pricing.

5.5 Commission Calculation

Seller commissions are calculated on the gross merchandise value of each transaction before any deductions for shipping, taxes, or payment processing fees. Commissions are deducted from the seller's payout automatically at the time of settlement.

5.6 Beta Tester and Founding Seller Terms

The original founding sellers are a closed, grandfathered cohort. They retain a 1% platform commission permanently; founding sellers pay the same standard subscription price as all other sellers (Starter $79/mo, Creator+ $199/mo, Pro $499/mo). There is no discounted or founding subscription rate.

The Streamster founding/beta program is closed to new signups. Sellers previously accepted into the program ("Founding Sellers") retain their grandfathered 1% platform commission for the life of the account and pay the standard subscription price as all other sellers. All other sellers pay the standard subscription price plus the tiered commission: Starter 4%, Creator+ 2%, Pro 1%. There is no free promotional subscription period for new signups.

5.6.1 Beta Activation Requirements

To maintain Beta Tester status, users must satisfy the following activation and ongoing activity requirements:

  • Initial Activation (7 days): Within seven (7) calendar days of signing up, Beta Testers must complete at least one of the following: (a) create at least one product listing; (b) conduct at least one live stream; or (c) import products via CSV into their Streamster account.
  • Ongoing Activity (30-day rolling window): After initial activation, Beta Testers must demonstrate continued activity within any rolling 30-day period by completing at least one of the above actions. Failure to maintain activity within any 30-day window may result in revocation of beta status.
  • Revocation: If a Beta Tester fails to meet the initial activation requirement or the ongoing activity requirement, Streamster reserves the right to revoke their beta access immediately. Upon revocation, the user will be required to subscribe to a paid plan (Starter or Pro) at standard pricing to continue accessing the Service. Revoked beta spots will be made available to users on the waitlist.
  • No Refunds or Reinstatement: Revocation of beta status is final. Revoked users are not entitled to reinstatement of beta benefits, and no compensation or credit shall be provided for any unused portion of the beta period.

Beta Tester and Founding Seller benefits are non-transferable and are subject to the applicable program agreement. Streamster reserves the right to modify, restructure, or terminate any Beta Program or Founding Seller commission terms at any time with ninety (90) days' written notice. Such modifications may include changes to discount percentages, commission rates, plan access levels, or the complete discontinuation of promotional pricing. Continued use of the Service after the effective date of any such modification constitutes acceptance of the revised terms.

5.6 Price Changes and Fee Modifications

Streamster reserves the right to modify, increase, decrease, or restructure any and all pricing, subscription fees, commission rates, service fees, buyer fees, and any other fees or charges associated with the Service at any time and at its sole discretion. Specifically:

  • Changes to subscription plan pricing will be communicated with at least thirty (30) days' prior written notice via email and/or Platform notification;
  • Changes to commission rates may take effect immediately for all new transactions initiated after the date of the change;
  • New fees or charges may be introduced at any time with thirty (30) days' prior notice;
  • Streamster may introduce, modify, or discontinue trials or promotional pricing at any time without notice;
  • Your continued use of the Service after the effective date of any fee change constitutes your acceptance of the new fees. If you do not agree to the modified fees, you must discontinue use of the Service before the changes take effect.

6. Tax Responsibility

You are solely responsible for determining, collecting, reporting, and remitting all applicable taxes arising from your use of the Service, including but not limited to: income taxes, self-employment taxes, sales taxes, use taxes, value-added taxes (VAT), goods and services taxes (GST), and any other federal, state, local, or international taxes. Sellers are responsible for collecting and remitting any applicable sales tax on transactions conducted through the Platform. Streamster does not provide tax advice, does not calculate or collect sales tax on behalf of sellers, and makes no representations regarding your tax obligations. You agree to indemnify and hold Streamster harmless from any claims, penalties, or liabilities arising from your failure to comply with applicable tax laws.

7. Electronic Communications Consent

By creating an account or using the Service, you consent to receive electronic communications from Streamster, including but not limited to: emails, platform notifications, push notifications, and in-app messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Transactional communications (order confirmations, payment notifications, security alerts, legal notices, and account-related messages) are essential to the operation of the Service and cannot be opted out of. You may opt out of marketing and promotional communications through your account notification preferences or by clicking the "unsubscribe" link in any marketing email, but opting out of marketing does not affect transactional or legal communications.

8. Intellectual Property, Content Licensing, and DMCA

"Streamster," the Streamster logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Streamster or its affiliates. You may not use such marks without our prior written permission.

8.1 User Content License Grant

You retain ownership of all content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant Streamster an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit your User Content in any media format and through any channels, for the purposes of operating, promoting, marketing, advertising, and improving the Service, and for any other lawful business purpose. This includes, without limitation, the right to use your User Content in promotional materials, social media, advertisements, case studies, and partner communications.

8.2 License Survival

The license granted in Section 8.1 survives the termination or expiration of your account and these Terms. Streamster may continue to use, display, and distribute User Content that was submitted prior to termination for any purpose described herein, even after your account is closed or terminated.

8.3 Content Representations

You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant the foregoing license, and that your User Content does not infringe or violate any third party's intellectual property rights, privacy rights, or other legal rights.

8.4 DMCA and Intellectual Property Complaints

Streamster respects the intellectual property rights of others and expects users to do the same. If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please submit a notice containing the following information to our designated agent:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Streamster to locate the material on the Platform;
  • Your contact information (address, telephone number, and email address);
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Send DMCA notices to: support@streamster.shop with the subject line "DMCA Takedown Request." Streamster reserves the right to remove allegedly infringing content without prior notice. Repeat infringers may have their accounts terminated.

9. Prohibited Content and Conduct

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation;
  • Sell counterfeit, stolen, illegal, or regulated goods without proper authorization;
  • Post or transmit content that is defamatory, obscene, pornographic, abusive, threatening, or hateful;
  • Engage in fraud, deceptive practices, or misrepresentation of products or services;
  • Infringe upon the intellectual property rights of any third party;
  • Transmit viruses, malware, or other harmful code;
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Scrape, harvest, or collect data from the Service without authorization;
  • Circumvent any fee, commission, or payment obligation owed to Streamster;
  • Engage in market manipulation or artificial inflation of metrics;
  • Use the Platform for money laundering, terrorist financing, or any other financial crime.

Streamster reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing offending content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

10. Data Retention and Deletion

We keep personal data only for as long as we need it, or for as long as the law requires. The categories and periods are set out in our Privacy Policy.

You may ask us to delete your personal data, and we will. Sellers can request deletion from Dashboard → Settings → Danger Zone, or by writing to us. We will action the request within 30 days and tell you what we did.

By using the Service, you acknowledge the following:

  • Records of completed transactions — order references, amounts, tax, dates, and the buyer's delivery details — are retained after an account is deleted, for as long as tax and accounting law requires and while a payment dispute could still be raised. These are records of a dealing between a buyer and a seller and are not the seller's alone to erase;
  • Where a retained record contains personal information that is not needed for that purpose, we remove that information rather than the whole record;
  • You may opt out of marketing communications at any time through your notification preferences;
  • Transactional communications (order confirmations, security alerts, payment notifications, and legal notices) cannot be opted out of while your account is open;
  • Data is encrypted in transit, and encrypted at rest by our cloud infrastructure provider;
  • Streamster may process data reasonably necessary for platform operation, legal compliance, fraud prevention and analytics;
  • Streamster may share anonymised, de-identified or aggregated data with third parties for analytics, research or business purposes;
  • Streamster may comply with law enforcement requests, subpoenas, court orders or governmental inquiries and disclose user data without prior notification where legally permitted or required.

11. Account Termination, Suspension, and Banning

Streamster may, at its sole and absolute discretion, suspend, restrict, or permanently terminate any user account, with or without cause, with or without prior notice, at any time. Grounds for termination include, but are not limited to: (a) violation of these Terms or any Streamster policy; (b) fraudulent, deceptive, or illegal activity; (c) posting or streaming harmful, offensive, or objectionable content; (d) abuse of platform features, systems, or other users; (e) failure to pay fees when due; (f) requests by law enforcement or government agencies; (g) legal compliance requirements; (h) extended periods of inactivity; (i) unexpected technical or security issues; or (j) any other reason Streamster deems appropriate in its sole judgment. Streamster is under no obligation to provide a reason or explanation for any suspension, restriction, or termination.

Upon termination by Streamster: (a) your right to use the Service immediately ceases; (b) any pending transactions will be completed or cancelled at Streamster's discretion; (c) unpaid seller balances above the applicable minimum payout threshold will be paid out within thirty (30) days, less any applicable fees, chargebacks, or amounts owed to Streamster; (d) pending payouts below the minimum payout threshold are forfeited; (e) your data will be retained or deleted as described in Section 10; and (f) the content license granted in Section 8 shall survive termination.

Streamster reserves the right to ban terminated users from creating new accounts on the Platform. Any attempt to circumvent a ban by creating a new account under a different identity or through any other means constitutes a violation of these Terms and may result in immediate termination of the new account and further legal action.

You may terminate your account at any time by contacting support@streamster.shop. Voluntary termination is subject to the same data retention and content licensing provisions described above.

12. Service Modifications and Discontinuation

Streamster reserves the right, at any time and without liability, to modify, update, suspend, or permanently discontinue any feature, functionality, tool, API, integration, or aspect of the Service, or the entire Platform itself, with or without notice. Without limiting the generality of the foregoing:

  • Features may be added, modified, deprecated, or removed at any time without prior notice;
  • API access, webhooks, integrations, and developer tools may be modified, rate-limited, or revoked at any time;
  • Streamster does not guarantee any specific level of uptime, availability, performance, or continued operation of the Service;
  • Scheduled or unscheduled maintenance may result in temporary unavailability of all or part of the Service;
  • Streamster shall have no liability to you or any third party for any modification, suspension, or discontinuation of the Service or any part thereof.

13. Dispute Resolution and Arbitration

13.1 Buyer-Seller Disputes

Streamster provides tools for buyers and sellers to resolve disputes directly. Streamster may, at its sole discretion, mediate disputes but is not obligated to do so. Streamster is not a party to any transaction and shall not be held liable for any disputes arising between buyers and sellers.

13.2 Mandatory Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with Streamster ("Dispute") shall first be attempted to be resolved through informal negotiation by contacting support@streamster.shop. If the Dispute cannot be resolved through informal negotiation within sixty (60) days, the Dispute shall be resolved exclusively through final and binding arbitration, not in court, administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator in Arlington County, Commonwealth of Virginia. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE OR CONSOLIDATED PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.

13.4 Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court, provided the action remains in small claims court and is not removed or transferred to a court of general jurisdiction.

13.5 Equitable Relief

Nothing in this Section shall prevent Streamster from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of Streamster's intellectual property rights, data rights, or confidentiality obligations.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STREAMSTER, ITS OWNER, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SALES, LOSS OF BUSINESS, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF USE, OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY TRANSACTION CONDUCTED THROUGH THE SERVICE, ANY CONTENT OR PRODUCTS OBTAINED THROUGH THE SERVICE, OR ANY OTHER MATTER RELATING TO THE SERVICE, EVEN IF STREAMSTER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL STREAMSTER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE LESSER OF: (A) THE TOTAL AMOUNT OF FEES ACTUALLY PAID BY YOU TO STREAMSTER IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. STREAMSTER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. STREAMSTER MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT, INFORMATION, SOFTWARE, TEXT, GRAPHICS, OR LINKS PROVIDED THROUGH THE SERVICE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM STREAMSTER OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHICH MEANS THAT SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN THESE JURISDICTIONS, STREAMSTER'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

15. Indemnification

You agree to defend, indemnify, and hold harmless Streamster, its owner, officers, employees, agents, contractors, and affiliates from and against any and all claims, demands, actions, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorneys' fees, court costs, and costs of investigation) arising from or related to: (a) your use of and access to the Service; (b) your violation of these Terms or any Streamster policy; (c) your violation of any applicable law, regulation, or third-party right, including any intellectual property, property, privacy, or publicity right; (d) any claim that your User Content caused damage to a third party; (e) any products or services you sell, offer, or promote through the Platform, including claims related to product liability, product defects, false advertising, or consumer protection; (f) your transactions with buyers or sellers on the Platform; (g) any tax obligations arising from your use of the Service; or (h) any dispute between you and any other user of the Service. This indemnification obligation shall survive the termination of these Terms and your use of the Service.

16. Force Majeure

Streamster shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond Streamster's reasonable control, including but not limited to: acts of God; natural disasters (earthquakes, floods, hurricanes, fires); pandemics, epidemics, or public health emergencies; war, armed conflict, terrorism, or civil unrest; government actions, sanctions, embargoes, or regulatory changes; cyber attacks, hacking, distributed denial-of-service attacks, or other security incidents; power outages or infrastructure failures; failures or outages of third-party services (including but not limited to Stripe, Mux, cloud hosting providers, content delivery networks, and internet service providers); labor disputes or shortages; supply chain disruptions; or any other event or circumstance beyond Streamster's reasonable control. During any such event, Streamster's obligations under these Terms shall be suspended for the duration of the event, and Streamster shall have no liability for any resulting impact on the Service.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration under Section 13 shall be brought exclusively in the state or federal courts located in Arlington County, Commonwealth of Virginia, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.

18. Assignment

Streamster may freely assign, transfer, delegate, or sublicense its rights and obligations under these Terms, in whole or in part, to any person or entity, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of Streamster's assets, without your consent or prior notice. You may not assign, transfer, or delegate your rights or obligations under these Terms or your account without Streamster's prior written consent. Any purported assignment in violation of this Section shall be null and void.

19. Modification of Terms

Streamster reserves the right to modify, amend, or replace these Terms at any time and at its sole discretion. Modifications will be handled as follows:

  • Material Changes: We will provide at least thirty (30) days' prior written notice of material changes via email to the address associated with your account and/or by posting a prominent notice on the Platform. The "Last Updated" date at the top of these Terms will be revised accordingly.
  • Non-Material Changes: Minor, clarifying, or administrative changes may take effect immediately upon posting to the Platform without separate notice.
  • Acceptance: Your continued use of the Service after the effective date of any modifications constitutes your binding acceptance of the revised Terms. If you do not agree to the modified Terms, your sole remedy is to discontinue use of the Service before the changes take effect.

It is your responsibility to review these Terms periodically. Streamster is not obligated to notify you of non-material changes.

20. Survival

The following provisions shall survive the expiration or termination of these Terms, your account, or your use of the Service, and shall continue in full force and effect: Intellectual Property and Content Licensing (Section 8), Data Retention and Deletion (Section 10), Dispute Resolution and Arbitration (Section 13), Limitation of Liability (Section 14), Indemnification (Section 15), Force Majeure (Section 16), Governing Law and Jurisdiction (Section 17), Assignment (Section 18), this Survival clause (Section 20), and any other provisions that by their nature are intended to survive termination.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

22. Reservation of Rights and Waiver

Streamster reserves all rights not expressly granted to you in these Terms. No failure or delay by Streamster in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. Streamster may exercise any and all legal, equitable, or other remedies available to it under applicable law.

23. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any other legal notices or agreements published by Streamster on the Platform, constitute the entire agreement between you and Streamster concerning your use of the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Streamster with respect to the Service.

24. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Streamster, including but not limited to social media platforms, payment processors, and external content. Streamster has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Streamster shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. We strongly encourage you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

25. No Guarantee of Results

Streamster makes no representations, warranties, or guarantees regarding the amount of sales, revenue, income, profits, viewers, customers, or any other measure of success that any user may achieve through the Service. Results vary based on many factors outside of Streamster's control, including but not limited to: product quality, pricing, market conditions, competition, seller effort, marketing strategy, and audience engagement. Any examples, projections, or case studies shared on the Platform or in marketing materials are for illustrative purposes only and do not constitute guarantees of future performance. You acknowledge that Streamster is not responsible for the commercial success or failure of any seller, product, or stream on the Platform.

26. No Agency or Representation

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Streamster. You may not represent yourself as an agent, employee, representative, or affiliate of Streamster, or make any binding commitments on behalf of Streamster. You may not use Streamster's name, trademarks, or branding in any manner that suggests an endorsement, sponsorship, or affiliation beyond your status as a registered user of the Platform, without Streamster's prior written consent.

27. Anti-Money Laundering and Sanctions Compliance

You represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to United States economic sanctions, and that you are not on any U.S. government restricted parties list, including but not limited to the Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List, the U.S. Department of Commerce Denied Persons List, or any similar list maintained by any other applicable jurisdiction. You agree not to use the Service for any purpose prohibited by applicable anti-money laundering laws, counter-terrorism financing laws, sanctions regulations, or export control regulations. Streamster reserves the right to immediately suspend or terminate any account and freeze any funds where there is reasonable suspicion of money laundering, terrorist financing, sanctions evasion, or other financial crime, and to report such activity to the appropriate authorities.

28. Export Controls

The Service and any software, technology, or data provided through the Service may be subject to United States export control laws and regulations, including the Export Administration Regulations (EAR) and sanctions regulations administered by OFAC. You agree to comply with all applicable export control and sanctions laws and regulations. You may not access, use, export, re-export, or transfer the Service or any related technology to any country, entity, or person prohibited by applicable law without the required government authorizations.

29. Accessibility

Streamster is committed to making the Platform accessible to all users, including those with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at the AA level. If you experience any accessibility barriers while using the Service, please contact us at support@streamster.shop and we will make reasonable efforts to provide the information or functionality you need through an alternative method.
